Booking Term and Conditions

 

1. The Reservation Process

 

Reservations for accommodation at Invercreran House (the property) by the person making the reservation (you) and guests and any person accompanying them (each a Guest) are dealt with as between each Guest and the owners of Invercreran House (Owner or we or us) by these Terms and Conditions.

 

We may agree to you making a provisional booking with us, but this is not legally binding on either you or us. A provisional booking can be held for up to 48 hours, after which time it will be cancelled automatically if we have not received payment of the deposit or full payment of the booking.

 

A legally binding contract is in place between the Owner and the Guests once these Terms and Conditions have been accepted, which will be deemed to have occurred by the deposit payment being received in cleared funds and confirmed by the Owner. Despite a legally binding contract being in place, you must make sure that each of the Guests has seen and agreed to be bound by these Terms and Conditions.

 

Once a legally binding contract is in place, these Terms and Conditions are binding upon each Guest, including the person who made the booking, should that person not be a Guest.

 

A 30% deposit is required to secure the booking and is not refundable under any circumstances if you subsequently cancel a confirmed booking. Payments can be made by bank transfer. The balance falls due 30 days prior to your arrival at Invercreran House. Reservations made less than 30 days prior to the scheduled arrival of Guests require full payment to secure the booking.

 

As soon as your confirmation is received, please check the details carefully and, if anything is incorrect, please inform us immediately. The Owner will not be responsible for any liability or costs or expenses incurred by any Guest if we are not notified of any inaccuracies in the booking or documentation.

 

2. Good Housekeeping Deposits

 

A good housekeeping deposit of £750 is required for each booking. In the event of any cost of rectification occurring as a result of loss or damage caused by any action or inaction of any Guest or any visitor (Rectification Costs), the Owner reserves the right to claim the Rectification Costs from the good housekeeping deposit.

 

Should no Rectification Costs be incurred, the good housekeeping deposit will be refunded within ten working days of the Guests’ departure from Invercreran House. For the avoidance of doubt, this good housekeeping deposit is separate from and in addition to the 30% booking deposit.

 

In the event the Rectification Costs exceed £750, you will be notified in writing of any additional amount owed and the Guests will ensure the additional amount is paid to the Owner within ten working days of the Guests’ departure.

 

3. Cancellation by Guests

 

Where a cancellation notice is received after the deposit has been paid and before the balance is due, you are still liable to pay the final balance on the due date, unless Invercreran House have successfully resold the holiday dates.

 

If Invercreran House is unable to sell any part of the cancelled period then all monies will be forfeit.

 

4. Cancellations by Owner

 

It is extremely unlikely that the Owner will cancel any confirmed booking, however, the Owner is entitled to do so. Guests will be informed as soon as possible and the deposit/balance, if already settled, will be refunded in these circumstances. We cannot be held liable for any unforeseen additional costs or expenses incurred by you or your party (such as travel).  

 

5. Insurance

 

We strongly recommend that all Guests obtain holiday cancellation cover insurance.

 

6. Party Size

 

There are limits on the maximum number of guests that can be in Invercreran House and the number of guests at the property must not exceed this limit. The maximum number of persons to be in the property at any one time is 10 named individuals.

 

7. Term

 

The booking period is for a minimum of 3 nights and a maximum of 14 nights.

8. Use of Property

 

Under no circumstances should children staying at Invercreran House be left unsupervised.  In particular, children must always be supervised near or in the hot tub area.

 

No outside suppliers may be used at Invercreran House without the prior written consent of the Owner or managers and suitable Public Liability Insurance having been shown to the Owner prior to the suppliers’ and/or guests’ arrival at Invercreran House.

 

The Owner does not accept stag or hen parties and reserves the right to refuse admission to the property or ask all or any of the Guests to vacate the property with immediate effect if any of the Guests fails to adhere to this condition or any other term of these Terms and Conditions.

 

Invercreran House is to be used as holiday accommodation for you, or your organisation, or the Guests. It is not for use as the principal or additional home or residence of Guests; and no Guests will be entitled to a tenancy. No relationship of landlord and tenant is created, and no statutory security of tenure is created, and no statutory security of tenure exists now or when the period of occupation ends.

 

Invercreran House is in a rural area and has a septic tank. If anything other than toilet tissue is flushed down any WC in the house and causes blockage, this will result in a deduction taken from the Rectification Costs.

 

No motor homes, camper vans, caravans or tents are to be pitched at Invercreran House under any circumstances.

 

There is a no smoking policy inside the property, and discarded cigarettes outside the house must be disposed of correctly into a bin.

 

Recycling bins are located at the property for Guests to use. Guests must put the correct items into each bin.

 

It is not acceptable to move furniture within the property. In the event of any damage to property or equipment during the stay, you must notify the house management. You agree not to decorate walls or woodwork using drawing pins, sellotape, or blu-tac.

 

9. Your Responsibilities

 

Guests must:

 

9.1 take all reasonable care of the property and the area around the property and must leave Invercreran House in the same state at the end of the rental period as found in the beginning (which includes leaving Invercreran House in a suitable level of cleanliness);

 

9.2 ensure that they do not cause nuisance to neighbours and keep noise to a minimum after 11pm;

 

9.3 ensure that all information provided in connection with the booking is true, accurate, current and complete;

 

9.4 use Invercreran House lawfully, not abuse or damage any facilities provided as part of Invercreran House and comply with any health and safety or other policies or instructions notified to Guests by the Owner or manager in connection with Invercreran House;

 

9.5 allow the Owner or any representative of the Owner (including any tradespeople) to access Invercreran House at all reasonable times during the rental period as long as the Owner provides reasonable advance notice (other than in cases of emergency or the Owner becomes aware that any Guest has breached these Terms and Conditions or has reasonable suspicion to believe a Guest has breached these Terms and Conditions);

 

9.6 return all keys/access cards for Invercreran House on departure to the location requested by the Owner, or as the Owner may otherwise request; and

 

9.7 ensure Invercreran House is used only for legal purposes, and any other use including but not limited to illicit drug use, verbal or physical abuse of any person or illegal sexual behaviour will result in immediate termination of the booking and removal of the Guests from the property with no refund of paid fees.

 

10. Gym

 

The Guests must use reasonable care and diligence while using the gym equipment at Invercreran House. The Owner accepts no liability for accident or injury that occurs when any Guest uses the gym equipment, which the Guests use at their own risk.

 

The gym equipment provided at Invercreran House typically include two treadmills, an exercise bike, a bench and a set of dumbbell weights. However the gym equipment provided is at the Owner’s discretion and may be subject to change without notice.

 

11. Hot Tub

 

Guests must adhere to the special rules and requirements relating to the use of the hot tub. They are for the safety of Guests. Please refer to the document entitled ‘Hot Tub Terms and Conditions’ for further information on the terms of use of the hot tub. Any misuse of the hot tub could cause injury or death and all Guests are deemed to have read and agreed to the Hot Tub Terms and Conditions.

 

12. Pets

 

Pets and animals of Guests, including but not limited to cats and dogs, are not permitted at Invercreran House or in the surrounding area.

 

13. Facilities and Services

 

The Owner will make every effort to ensure that Guests enjoy a peaceful stay, however we cannot guarantee or be held responsible for any failure or interruption of services including electricity, water or any damage to telephone, sky or terrestrial TV, broadband, internet and other communications, including disruption or noise caused as a result of repair works being carried out in the vicinity. Where the Owner is made aware of such failure or interruption, we will endeavour to rectify such services (to the extent within our control) as soon as reasonably practicable.

 

14. Liability

 

The Owner will not be responsible or liable for losses that any Guest suffers where it was not obvious that the loss would occur (so, in legal terms, the loss was unforeseeable).

 

The Owner will also not be responsible or liable to any Guests for any events outside of the Owner’s reasonable control, including but not limited to the breakdown of domestic appliances, gym equipment, plumbing, wiring, temporary invasion of pests, building works at adjacent properties, damage resulting from exceptional weather conditions or other unforeseeable circumstances.

 

The Owner accepts no liability for any loss, damage, additional expense or inconvenience directly or indirectly caused or arising out of Invercreran House, its plumbing, gas, electrical services, exceptional weather or damage caused by a Force Majeure event (described below). No responsibility is accepted for loss or damage of property, vehicles or vehicle contents belonging to Guests or any visitors during their occupancy of Invercreran House.

 

If any Guest is an organisation, corporate entity or legal person of any kind, we will incur no liability for losses directly or indirectly arising in relation to Invercreran House in connection with that Guest’s trade, business, craft or profession.

 

Each of the Guests will be jointly and severally liable for their obligations under these Terms and Conditions, and the Owner may take action against, or release or compromise the liability of any Guest without affecting the liability of any other Guest.

 

15. Force Majeure

 

If, for circumstances outside of the control of the Owner or the Guests (including but not limited to war, natural disaster, civil strife, terrorist action, industrial disputes, fire, sickness, extreme weather, epidemic, pandemic or ‘acts of God’), either party cannot fulfil their obligations under these Terms and Conditions, then that party will not be responsible for those losses.

 

16. Problems or Complaints

 

Please report any pre-existing damage noticed upon arrival within 24 hours. If any issues arise during your stay you must contact the house management as soon as reasonably practicable for the issue to be investigated and, if required, to take any remedial action.

 

17. Miscellaneous

 

All conditions, warranties or other terms which might have effect between the parties or be implied or incorporated into these Terms and Conditions or any collateral contract, whether by statute, common law or otherwise, are, to the extent permitted by law, excluded. 

 

No variation of these Terms and Conditions will be valid unless it is in writing and signed by or on behalf of each of the parties. 

 

A waiver of any right under these Terms and Conditions is only effective if it is in writing.  No failure or delay by a party in exercising any right or remedy under these Terms and Conditions or by law will constitute a waiver of that (or any other) right or remedy, nor preclude or restrict its further exercise. 

 

If any provision of these Terms and Conditions is or becomes illegal, invalid or unenforceable under the law of any jurisdiction, that will not affect or impair the legality, validity or enforceability in that jurisdiction of any other provision of these Terms and Conditions, or the legality, validity or enforceability under the law of any other jurisdiction of that or any other provision of these Terms and Conditions.

 

These Terms and Conditions and the Hot Tub Terms and Conditions constitute the whole agreement between the parties and supersede all previous agreements between the parties relating to its subject matter.  Each party acknowledges that, in entering into these Terms and Conditions, it has not relied on, and will have no right or remedy in respect of, any statement, representation, misrepresentation, assurance or warranty (whether made negligently or innocently) other than as expressly set out in these Terms and Conditions.  Nothing in this clause will limit or exclude any liability for fraud.

 

Guests are not entitled, without the prior written consent of the Owner, to assign, transfer, charge, mortgage, subcontract or deal in any manner with all or any of their rights or obligations under these Terms and Conditions.

 

The Owner may at any time assign, transfer, charge, mortgage, subcontract or deal in any other manner with all or any of its rights under these Terms and Conditions and may subcontract or delegate in any manner any or all of its obligations under these Terms and Conditions to any third party or agent.

 

Neither party will have authority to act as agent for, or to bind, the other party in any way.

 

No person who is not a party to these Terms and Conditions will have any right to enforce it pursuant to the Contracts (Rights of Third Parties) Act 1999.

 

The parties irrevocably agree for the exclusive benefit of the Owner that these Terms and Conditions are to be governed by and construed in accordance with English law and the English courts will have exclusive jurisdiction over any disputes or matters arising out of these Terms and Conditions.  Nothing in this clause will limit the right of the Owner to take proceedings against any Guest in any other court of competent jurisdiction, nor will the taking of proceedings in any one or more jurisdictions preclude the taking of proceedings in other jurisdictions, whether concurrently or not, to the extent permitted by the law of such other jurisdictions.

 

18. Arrival and Departure Times

 

Check in time is from midday and check out time is by midday.

Hot Tub Terms and Conditions

1. General

 

These Hot Tub Terms and Conditions are between any guests staying at Invercreran House (Guests or you or your) and the owner of Invercreran House (Owner or we).

 

Just like other physical activities, bathing in a hot tub could also bring certain health and safety risks. These are, in principle, the same as risks when bathing at home in the bathroom and they can be reduced by consistently following these Hot Tub Terms and Conditions.

 

By making a booking of Invercreran House, each Guest is deemed to have accepted these Hot Tub Terms and Conditions. Guests should not use the hot tub if they do not agree with or accept these Hot Tub Terms and Conditions.

 

These Hot Tub Terms and Conditions should be read in conjunction with the main Terms and Conditions

 

2. Hot Tub Faults and Checks

 

The hot tub at Invercreran House is a complimentary extra only for the private use of Guests. While we will take reasonable steps to provide continuation of this facility, should the hot tub stop working due to a fault that we cannot repair immediately during your stay, there will be no refund of the holiday amount paid (or any part of it).

 

The hot tub water is checked regularly and the Owner will liaise with the Guests regarding a suitable time to carry out these checks and the Guests will act reasonably in agreeing such a time.

 

If any fault or damage occurs with the hot tub please contact the Owner at the earliest convenient moment.

 

For your own safety, the hot tub water has a product called Bromine added. The water is monitored and tested daily by Invercreran House maintenance staff.

 

3. Health and Safety

 

The maximum recommended temperature is 38 degrees Celsius. A temperature of 37-39 degrees Celsius provides a pleasant bathing experience because it is slightly warmer than body temperature. The hot tub is electronically controlled to settle at 38 degrees Celsius.

 

It is recommended to keep hydrated and to drink enough water while bathing.

 

The heat of the hot tub water speeds up the effects of alcohol and can cause sleepiness, dizziness and unconsciousness. Extra caution must be taken whenever alcohol is being consumed, before or during the hot tub use.

 

4. Guest’s Considerations and Responsibilities

 

Each Guest’s use of the hot tub is conditional on having considered the following points and taking personal responsibility regarding their enforcement:

4.1 The maximum number of people that can use the hot tub at any one time is six;

4.2 Care must be taken when entering and leaving the hot tub. When leaving the hot tub leg muscles may be relaxed enough to make you unsteady;

4.3 Guests must shower with soap and water before and after using the hot tub. Showering before use washes away many of the common skin bacteria and removes lotions, deodorants, creams etc. which reduce the effectiveness of the spa sanitizer which disinfects the water;

4.4 The hot tub cover must be always be left in place when not in use;

4.5 Care must be taken on the hot tub steps, as water from the hot tub can cause the steps and surrounding area to be slippery. Deck tiles are non-slip but Guests should wear footwear at all times while walking on the deck, as surface water can cause slips;

4.6 If any allergic reaction occurs, leave the hot tub and rinse off in the shower. If the reaction persists contact the Owner or go to the local doctor at Port Appin Surgery, Port Appin, PA38 4DE. 4.7 Persons with skin, ear, genital or other body infections, open sores or wounds should not use the hot tub because of the possibility of spreading infection or irritating your condition;

4.8 Persons with heart disease, diabetes, low or high blood pressure, asthma, respiratory problems or any serious illness should not enter the hot tub without prior consultation with their doctor;

4.9 Persons with recent laser hair removal should not enter the hot tub without prior consultation with their doctor;

4.10 Persons who are pregnant should not enter the hot tub without prior consultation with their doctor;

4.11 Any Guest who permits their children to use the hot tub does so at their own risk;

A Guest who does not comply with their responsibilities is solely responsible for any damage or issues which may arise as a result.

 

5. Prohibited Activities

 

Each Guest undertakes to not do any of the following activities:

 

5.1 Use the hot tub whilst using or after using narcotics or other drugs that may cause sleepiness, drowsiness or raise or lower blood pressure;

5.2 Use the hot tub while intoxicated;

5.3 Jump into or into or climb on or in the vicinity of the hot tub;

5.4 Eat whilst using the hot tub. Food particles may break down, contaminating the water and the internal surfaces of the hot tub. This causes damage to the hot tub and will become your liability if you eat whilst bathing;

5.5 Swallow the hot tub water;

5.6 Use shampoos, soaps and oils in the hot tub. These create unpleasant particles in the water, upset the pH balance and damage the hot tub. Please bear in mind that the hot tub is not for cleaning your body. This experience is to help you to clear your mind and relax;

5.7 Use the hot tub immediately after a heavy meal;

5.8 Use the hot tub alone;

5.9 Immerse your head in the hot tub water;

5.10 Use glass or knives near or in the hot tub, or while on the outdoor decking area;

5.11 Use any electrical appliances near or in the hot tub;

5.12 Sit or walk on the hot tub;

5.13 Enter the hot tub immediately after exercising;

5.14 Turn the hot tub isolation switch off (the hot tub requires power to carry out the cleaning cycles);

5.15 Leave children unattended while in the hot tub or the surrounding area;

5.16 Allow babies or toddlers to use the hot tub; and

5.17 Use the hot tub with any of the following conditions: fever or any flu-like symptoms, diarrhoea and/or vomiting, at the time or during the previous five days.

A Guest who carries out any of these prohibited activities is solely responsible for any damage or issues which may arise as a result.

 

6. Liability

 

The Owner will not be responsible or liable for losses that any Guest suffers where it was not obvious that the loss would occur (so, in legal terms, the loss was unforeseeable).

 

The Owner will also not be responsible or liable to any Guests for any events outside of the Owner’s reasonable control in relation to the hot tub, including but not limited to the breakdown of the hot tub, temporary invasion of pests, damage resulting from exceptional weather conditions or other unforeseeable circumstances.

 

The Owner will not be responsible or liable for accidents caused by irresponsible behaviour of Guests or any behaviour that is inconsistent with these Hot Tub Terms and Conditions.

 

The Owner accepts no liability for any loss, damage, additional expense or inconvenience directly or indirectly caused or arising out of the use of the hot tub or damage caused by a Force Majeure event (as described in the main Terms and Conditions).

 

If any Guest is an organisation, corporate entity or legal person of any kind, we will incur no liability for losses directly or indirectly arising in relation to the hot tub in connection with that Guest’s trade, business, craft or profession.

 

Each of the Guests will be jointly and severally liable for their obligations under these Hot Tub Terms and Conditions, and the Owner may take action against, or release or compromise the liability of any Guest without affecting the liability of any other Guest.

 

7. Disclaimer from Guest

 

Upon accepting these Hot Tub Terms and Conditions, each Guest is deemed to have made the following statement:

 

“I hereby confirm that the methods, precautions and prohibitions in relation to using the Invercreran House hot tub contained in these Hot Tub Terms and Conditions have been read and understood.

 

I understand and accept that the only chemicals or substances allowed in the water are those added by the Owner. I confirm that I have read and understood the health and safety guidance provided by Invercreran House and I am fully aware of the potential risks to health of hot water bathing.

 

I confirm that the Owner is not liable for any injury or contamination as a result of my failure to abide by these Hot Tub Terms and Conditions or failure to exercise reasonable care and diligence.

 

I am aware of the possible health and safety risks of entering the hot tub.

 

I confirm that I and all other guests with me will allow the Owner or any representative of the Owner (including any tradespeople) an agreed time to check and maintain the hot tub if and when necessary.”

 

8. Miscellaneous

 

All conditions, warranties or other terms which might have effect between the parties or be implied or incorporated into these Hot Tub Terms and Conditions or any collateral contract, whether by statute, common law or otherwise, are, to the extent permitted by law, excluded.
